What is Criminal Mischief?
The Ohio Revised Code defines Criminal Mischief in R.C. 2909.07(A)(1):
“No person shall, without privilege to do so, knowingly move, deface, damage, destroy, or otherwise improperly tamper with the property of another.”
The prosecution must be able to prove that the property of another was damaged or tampered with in some way. There usually needs to be a change in the location or condition of the property in order for the prosecution to prevail on a charge of Criminal Mischief.
